I Was Injured In A Crash. How Can I Be Compensated?

If you’ve been injured in a motor vehicle crash that wasn’t your fault, you may be entitled to compensation.

Everyone’s rights are different, depending on the circumstances of the accident and the nature of the injuries. To give you an overview, here’s a summary of some of the main compensation pathways.

Workers’ Compensation

If you were travelling to, from or for work, you may be entitled to workers’ compensation. This can help cover lost earnings, treatment expenses and other losses you might experience as a result of your injuries.

CTP Compensation

If the accident was caused by a vehicle, you may be able to claim compensation for your injuries by lodging a claim with the at-fault vehicle’s compulsory third-party (CTP) insurer. CTP compensation can assist with costs such as pain and suffering, economic loss, medical treatment, care and assistance and more.

Public Liability Compensation

If the accident was caused by a public hazard—such as a pothole, road defect or poorly designed traffic light sequence—you may be able to claim compensation for your injuries from the party responsible (such as a government body, property owner or construction workers). Public liability compensation can also cover pain and suffering, economic loss, medical treatment and care.

Victim Assist

If the crash involved a violent crime (such as the dangerous or violent use of a motor vehicle), you may be entitled to financial and other support through Victim Assist Queensland.

Income Protection

If your injuries have affected your ability to work, you may be entitled to income protection benefits. Many people unknowingly hold income protection insurance, often through their superannuation.

Total Permanent Disability (TPD)

If your injuries have resulted in a significant disability that impacts your ability to work, you may be eligible for TPD benefits. Like income protection, TPD insurance is often included in superannuation policies.

National Injury Insurance Scheme Queensland (NIISQ)

If your injuries are severe, you may be eligible for compensation through the National Injury Insurance Scheme Queensland (NIISQ).

Where Should I Start?

Our recommendation: Investigate all possible claims, determine which ones you are eligible for and take action as soon as possible.

    • Some claims can complement each other.

    • Other claims overlap, offering extra benefits.

    • Some claims may even require you to pursue another claim first (e.g. one may depend on the other).

Each type of claim has its own time limits and eligibility criteria so it’s essential to act promptly.
